APPEAL OF HEARING DECISIONS OF THE REDEVELOPMENT AGENCY OF THE CITY OF SANTA CLARA MUST BE MADE TO THE SUPERIOR COURT WITHIN 90 CALENDAR DAYS OF FINAL ACTION.  BECAUSE OF THE AGENDA PROVISION FOR RECONSIDERATION, FINAL ACTION IS DEEMED TO OCCUR AT THE END OF THE NEXT REGULAR MEETING. (CODE OF CIVIL PROCEDURE SECTION 1094.6)

A.         Possible Reconsideration of Actions Taken at Immediately Preceding Meeting.  (See Summary of Actions which is attached to the posted Agenda for potential reconsideration).

 

5.         NEW BUSINESS:

 

A.         Request for approval of Amendment No. 2 to the Agreement with Jana Sokale Environmental Planning  in an amount not to exceed $99,830 for development of the San Tomas Aquino Creek Trail (Reaches 1 to 4).

 

B.        City Council and Redevelopment Agency regarding Bay Area Research and Extension Center (BAREC) property purchase located at 90 North Winchester Boulevard:

* Approval of the Redevelopment Agency purchase of six acres for $9.84 million for the construction of affordable senior housing and the selection of Charities Housing / Methodist Retirement Foundation to build and operate the senior housing

* Council direction to the City Manager to investigate and report back on the recommended location and feasibility of the neighborhood park and heritage orchard theme.

 

C.        Request for adoption of a Resolution finding benefit to the Redevelopment Project Areas from the use of Agency's Affordable Housing Funds and approval of the Owner Participation Agreement with B&D Development and Construction, Inc. for two Below Market Priced units within a 15-unit townhouse development project at 1025 Helen Avenue.

 

D.        Request for approval of an Agreement with H. T. Harvey and Associates for the Burrowing Owl Mitigation - North of Bayshore Projects in an amount not to exceed $40,000.

 

E.         Request for approval to pledge an allocation of $250,000 to the Housing Trust of Santa Clara County based on Council approval of an Agreement on August 19, 2003 and authorizing Resolutions.

 

6.         PUBLIC PRESENTATIONS:  The law does not permit Agency action on, or extended discussion of, any item not on the agenda except under special circumstances.
